Injury FAQs in Phoenix, AZ

What type of cases do you handle?

Ely, Bettini, Ulman, Rosenblatt & Ozer represents people who have been injured in a variety of circumstances. Our practice areas include medical malpractice, automobile or trucking accidents, injuries due to defective products or medications, construction site injuries, highway design and defect cases, cases against governmental entities such as the County or State of Arizona, workplace injuries, legal malpractice, as well as a variety of other cases. If you have been injured, we urge you to call for an absolutely free, no cost analysis of your case. You will speak directly with an attorney who will discuss your potential claim and advise you with respect to your legal rights. There is no charge for the initial consultation. We also have excellent relationships with lawyers in many different specialties. Even if your claim is not one of the above, feel free to call us at no charge, and we can refer you to a highly qualified attorney in another area of law to assist you in your inquiry.

How do I pay for your services?

Our cases are taken on a contingency fee basis. This means there are absolutely no attorney fees unless and until there is a recovery. In addition to attorney’s fees, there will typically also be “out-of-pocket” costs, which are costs we have to spend to prosecute your case. These costs include filing fees with the court, expert witness fees, costs for depositions, investigation, and other costs that are necessary to successfully bring the claim. These costs will be explained to you when you speak with the attorney. We will always work with the prospective client on how those costs are to be paid. This should not be a bar to considering whether to contact a lawyer. Each case is different, and financial arrangements can often be made to minimize or avoid this burden while the case is pending.

We pride ourselves on the fact that we entertain all calls and inquiries with respect to potential claims. Once again, when you call to discuss a potential claim, you will speak to a lawyer for advice. There is no charge for the initial case evaluation regardless of whether there is a claim to pursue. After the initial evaluation, if we take your case, all fees are contingent on the outcome. If there is no recovery, there is no attorney fee.

Will you come to my home for a legal consultation?

Often there are circumstances where a client is unable to come to our office for their no cost initial consultation. This can be due to a variety of reasons including medical or transportation problems or current hospitalization issues. Feel free to call and speak directly with one of our attorneys. We offer free in-home consultations in most circumstances and will come to see you.

Do you represent people who live outside the Phoenix metropolitan area?

Our office has represented injured people from all over the United States and throughout Arizona. This includes every county within Arizona as well. If you have been injured and live outside the Phoenix Metropolitan area, do not hesitate to call. We can help you bring a claim in Arizona regardless of where you reside. In addition, Burt Rosenblatt a partner in the firm, is also licensed and actively practicing in California along with Arizona. Burt handles numerous injury claims for people residing in Arizona or California. If you were injured in California and reside in Arizona, our office can help you with your claim.

I am injured and I don’t have health insurance. Can you help me find a doctor who will help me?

If you have been injured, and do not have health insurance, we can help direct you, in most circumstances, to a highly qualified physician who will provide care for our clients on a lien basis. A lien is an agreement between you, the physician, and our office to delay payment to the physician for his or her services until there is a recovery in your case. Due to our extensive experience in the field, we have developed excellent relationships with many different medical specialists who are exceptionally qualified in their respective fields. Often, these physicians will agree to see our clients on a lien basis given their respect for our office and past successful resolution of claims for patients.

In addition, if you have health insurance, we can often direct you to a particular physician who has outstanding qualifications and has been of assistance to our office on other claims. These physicians are typically very willing to be of assistance to you both from a medical and legal standpoint, helping with medical/legal reports, depositions, and testifying at trial.

What types of medical malpractice cases do you handle?

There are various types of medical malpractice cases including cases against individual physicians, nursing homes, hospitals, and other healthcare providers. Given our broad experience in all of these fields, we are uniquely able to assist in virtually all cases involving medical negligence. Among others, we have received a major verdict for an individual who was “dumped” from hospital care and was sent away by a hospital because he had no insurance. This “dumping” occurred despite the fact that the individual required emergency treatment. Since that case, it is now the law, statewide and nationally, that everyone has a right to be treated in an emergency, regardless of whether the person has insurance. In fact, the law now requires a hospital to treat an emergency patient regardless of whether the patient has health insurance coverage until the patient is considered medically stationary or otherwise stabilized.

We have also handled malpractice cases such as the following: 1) inattentive failure to make a proper diagnosis of various illnesses and diseases, 2) negligent injury of organs during surgery, 3) improperly performed surgical procedures, 4) negligent failure to remove instruments or other foreign bodies during surgery, 5) negligent credentialing of physicians, 6) nursing malpractice, 7) hospital acquired burns and injuries, and other medical negligence claims. If you feel you may have been the victim of medical malpractice, feel free to call for an evaluation of your potential claim.
